Lawyers in Azerbaijan are not subject to licensing requirements. Therefore, it may be difficult for clients to determine the authenticity and experience of legal services provided by Azerbaijani lawyers by referring to governmental permissions. Moreover, there is no mandatory insurance requirement in legal services in Azerbaijan; nor any applicable individual insurance policy rules applicable on Azerbaijani lawyers.
Given the above concerns, qualified Azerbaijani lawyers have bar membership in Azerbaijan Bar Association. Without membership in Azerbaijan Bar Association, it is prohibited for lawyers in Azerbaijan to represent clients in courts, including any type of disputes. Moreover, to be qualified to be addressed and recognized as a lawyers, diploma of lawyer from Azerbaijan or recognition of a foreign lawyer diploma by the Ministry of Education is required.
Some Azerbaijani lawyers obtain voluntary professional liability insurance on case by case practice, however this is a rare occasion. Therefore, if such insurance is expected, it must be expressly required from the lawyer, since these kind of insurances are not mandatory (e.g. unlike auditors) and attorneys and lawyers obtain them in specific cases required by the client.
Lawyers admitted to the Bar are called as “attorneys” (“vəkil” in Azerbaijani) and misuse of “attorney name” by non-attorneys (even if they hold lawyer diploma) is an administrative offence. A three years of practical legal experience and passing of specific bar admission tests (a two stage examination) is required in order to be admitted to Azerbaijan Bar Association.
Lawyers in Azerbaijan are usually specialized in legal advisory services and legal representation (attorney services) at Azerbaijani courts. Legal Services in Azerbaijan are in diverse nature, and if court division system is taken as the ruling principle, the following categories may be distinguished:
Commercial cases stem from business operations in nature, and usually includes cases regarding commercial transactions or transactions between legal entities. With the exception of commercial cases, the remaining civil life transactions and matters fall under civil cases (individual disputes, inheritance, family, employment, property rights et c)
Administrative cases cover matters where one party to the relations is a public authority. The widely practiced areas in administrative case category cover tax disputes, customs cases, judicial review of administrative body decisions and appeals from administrative decisions or actions. It could be interesting to note that administrative offences and judicial review of such offences is heard at civil courts (not administrative courts).
And last, criminal cases cover prosecution judicial review of criminal decisions, criminal trial and sentencing.
Azerbaijani lawyers are usually specialized in criminal or civil (covering commercial) cases, since the peculiarity and procedural requirements differ significantly. Only small percentage of lawyers are attorneys in Azerbaijan, and usually lawyers specializing in legal advisory attend courts non very often. The same is true for court and litigation lawyers: these lawyers in Azerbaijan are not specialized in legal advisory and are focused on dispute resolution, rather than dispute prevention.
Lawyers in Azerbaijan usually have second language skills, which could be English, Russian, Turkish as a general practice, and sometimes (although rarely) could be German and French languages.
